The Interested Party, despite being issued a nomination certificate of the same date, was not on the ODM list submitted to IEBC and was also listed as a UDM nominee. The IEBC Dispute Resolution Committee had already upheld the Applicant's nomination and dismissed the challenge against him. The IEBC's subsequent acceptance of the Interested Party's nomination papers as ODM nominee was therefore unlawful, fraudulent, and contrary to both the Elections Act and the Committee's ruling.
