The High Court lacks jurisdiction to entertain challenges to the validity of the nomination or election of a County Assembly member by way of judicial review. Section 75(1A) of the Elections Act, 2011 expressly vests such jurisdiction in the Resident Magistrate's Court designated by the Chief Justice, to be exercised through an election petition. The applicant's attempt to challenge the gazettement of the interested party as a County Assembly member via judicial review is misconceived and contrary to the statutory dispute resolution framework.
