Ratio Decidendi

The court found that the plea was properly taken in accordance with the law, as the charge was explained in a language the applicant understood, and the applicant admitted the facts. However, the trial court erred by not considering an option of a fine for a first offender, despite the law providing for such discretion. The sentence of one year imprisonment without an option of a fine was therefore set aside and substituted with a fine of Kshs. 60,000 or, in default, six months imprisonment. The revision powers under Section 364(1)(a) of the Criminal Procedure Code were exercised to ensure the sentence was proportionate and in line with statutory provisions.
