Procedural Posture

Criminal Case / Ruling on Prima Facie Case at Close of Prosecution

  1. 1 Whether the prosecution has established a prima facie case against the accused persons to require them to be placed on their defence.
  2. 2 Whether the accused persons should be informed of their rights in making their defence.

Ratio Decidendi

The court found that the prosecution, through the evidence adduced and particularly the testimony of PW4, had established a prima facie case against each of the accused persons on the charge of murder. Consequently, the accused were required to be placed on their defence in accordance with section 306(2) of the Criminal Procedure Code. The court further ensured that the accused were informed of their rights regarding the manner of making their defence, including the right to remain silent, to testify on oath or unsworn, and to call witnesses. The matter was then set for defence hearing, with the accused given time to consult their advocate regarding their defence strategy.
