Ratio Decidendi

The court, after considering the evidence tendered by the prosecution, found that a prima facie case had been established against the accused. The evidence presented, if unchallenged, would be sufficient to justify a conviction. Therefore, the accused is required to be put on his defence in accordance with section 306(2) of the Criminal Procedure Code. The court emphasized that at this stage, detailed reasons are not necessary unless the accused is to be acquitted on a no case to answer submission. The ruling is thus limited to the finding that the prosecution has made out a case to answer, and the accused must now present his defence.
