The court found that the prosecution had adduced evidence showing that the accused and the deceased were involved in a quarrel, after which the accused stomped on the deceased's abdomen. The deceased made dying declarations to several witnesses implicating the accused. Medical evidence confirmed that the cause of death was trauma to the abdomen resulting in peritonitis and shock. The court held that this evidence, if uncontroverted, would be sufficient to convict the accused. Therefore, a prima facie case had been established against the accused, warranting that he be put on his defence in accordance with Section 306(2) of the Criminal Procedure Code.
