Legal Issues
- 1 What is the appropriate sentence for a first offender convicted of manslaughter where the accused has been in custody for over four years and expresses remorse.
Ratio Decidendi
The court considered the fact that the accused was a first offender, had shown remorse, and had already spent over four years in custody. However, the gravity of the offence—loss of life—necessitated a custodial sentence. Balancing these factors, the court determined that an eight-year imprisonment term was appropriate, reflecting both the seriousness of the crime and the mitigating circumstances presented by the defence.

REPUBLIC OF KENYA
IN THE HIGH COURT OF KENYA AT GARISSA
CRIMINAL CASE NO. 5 OF 2014
REPUBLIC.................................................................PROSECUTOR
VERSUS
JACKSON MUKUNGI KIMUILU.....................................ACCUSED
SENTENCE
1. I have considered that the accused has no previous record, and is thus a first offender. His counsel has submitted that he was drunk, and is remorseful. He has been in custody since arrest in 2014 more than 4 years now.
2. A life has however been lost. It was a borderline case for manslaughter. I sentence accused to serve eight (8) years imprisonment.
Dated and delivered at Garissa this 20th day of December, 2018.
