Legal Issues
- 1 What is the appropriate sentence for the accused given the circumstances of the case.
- 2 Whether mitigating factors such as being a first offender, family situation, and time spent in custody should affect the sentence.
Ratio Decidendi
Although the law prescribes a death sentence for the offence, the court considered the accused's status as a first offender, his family circumstances, the positive presentence report, and the three years already spent in custody. However, the lack of remorse was an aggravating factor. Balancing these considerations, the court found that a custodial sentence of seven years' imprisonment was appropriate rather than the death penalty.

The accused is sentenced to seven years imprisonment. Right of appeal within 14 days explained.
Orders
- The accused shall serve seven (7) years imprisonment.

CRIMINAL CASE NO. 50 OF 2015
REPUBLIC...........................................PROSECUTOR
VERSUS
JACKSON MUTUMA M’MUNYUGI.......ACCUSED
S E N T E N C E
1. I have considered that the accused is a first offender. I have also considered that he is a father of 2 children and that his wife died in 2010.
2. I have taken into consideration the presentence report which is extremely positive of the accused.
3. I have considered that the accused has been in custody for now three years.
4. A life was lost at the hands of the accused. The sentence provided in law is death.
5. However, considering all the foregoing and in particular that the accused has not expressed any remorseness for his action. I hereby sentence him to serve (7) years imprisonment. Right of Appeal 14 days explained.
