Procedural Posture
Criminal Case / Ruling on No Case to Answer
Legal Issues
- 1 Whether the prosecution has established a prima facie case against each accused to require them to be put on their defence.
- 2 Whether the 2nd and 3rd accused should be acquitted under Section 306 of the Criminal Procedure Code.
Ratio Decidendi
The court found that the prosecution had established a prima facie case against the 1st accused, warranting him to be placed on his defence. However, the evidence against the 2nd and 3rd accused was insufficient, and as such, they were acquitted at this stage under Section 306 of the Criminal Procedure Code. The decision was based on the court's assessment of the evidence presented by the prosecution and the legal requirement that only those against whom a prima facie case is established should be called upon to defend themselves.
Court Disposition
1st accused to be placed on his defence; 2nd and 3rd accused acquitted under Section 306 CPC.
Orders
- The 1st accused, James Kinuthia Kaguora, is placed on his defence.
- The 2nd accused, Joseph Kamau Ngugi, is acquitted under Section 306 of the Criminal Procedure Code.

JOSEPH KAMAU NGUGI ………………………..................................………..… 2ND ACCUSED
SAMUEL NDUATI KARANJA ……………………...................................……….. 3RD ACCUSED
RULING
1. I have considered the evidence adduced by the prosecution in this case. Having done so, I am satisfied that a prima facie evidence has been established against the 1st accused to warrant the court to place him on his defence.
2. As for the 2nd and 3rd accused, I acquit them at this stage under Section 306 of the Criminal Procedure Code for reasons to be given later in judgement.
Dated at Nairobi this 1st day of October, 2015.
