None of the witnesses placed the accused at the scene of the crime or provided evidence directly linking him to the murder. The evidence instead pointed to another suspect, Joseph Kisilu, who disappeared after the incident, and to the existence of threats from sand harvesting brokers. The investigation was found to be inadequate, as the investigating officer did not pursue other leads or conduct forensic analysis to link the accused to the crime.
