Ratio Decidendi

The trial magistrate erred in imposing a default sentence of 12 months imprisonment for non-payment of a fine, contrary to the express provisions of Section 95 of the Wildlife Conservation and Management Act, which mandates a minimum imprisonment term of five years. Section 28 of the Penal Code is inapplicable where the written law creating the offence prescribes a mandatory minimum sentence. The High Court, exercising its revisionary jurisdiction, set aside the illegal default sentence and substituted it with the statutory minimum of five years imprisonment in default of payment of the fine. The proper sentence is a fine of Kshs 1,500,000 or, in default, five years imprisonment.
