The court found that, although no witness saw the accused set the deceased's house ablaze, there was credible circumstantial evidence pointing to her as the perpetrator. The evidence established that the deceased died from burns sustained when his house was unlawfully set on fire, and the accused had both motive and opportunity. The court applied the principle that a prima facie case is established if the evidence is such that a reasonable tribunal could convict if no explanation is offered by the defence. Therefore, the prosecution had met the threshold to require the accused to be placed on her defence for the charge of murder.
