The only eyewitness, PW1, did not see either accused inflict the fatal injury, and his evidence pointed to the bar owner, Wicki, as the person wielding the panga. The investigating officer's testimony was largely hearsay and lacked corroboration from other witnesses. The court held that to place the accused on their defence would be to require them to fill the evidentiary gaps left by the prosecution, which is contrary to the law.
