Criminal Case / Ruling on Whether a Prima Facie Case Has Been Established at Close of Prosecution's Case

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant putting him on his defence.
  2. 2 Whether there was sufficient evidence connecting the accused to the death of the deceased.

Ratio Decidendi

The court found that none of the prosecution witnesses provided evidence as to how the deceased met his death or connected the accused to the offence. The prosecution failed to adduce sufficient evidence to establish a prima facie case against the accused. Applying the principle from RAMANLAL TRAMPAKLAL BHATT VS R [1957] EA 332, the court held that a reasonable tribunal would not convict the accused on the evidence presented if no explanation was offered by the defence. Consequently, the accused was acquitted under Section 210 of the Criminal Procedure Code.
