Ratio Decidendi

The court found that the prosecution failed to establish any of the essential elements of the offence of murder. None of the witnesses saw the accused inflict injuries on the deceased, and there was no medical evidence to confirm the cause of death. The prosecution did not prove that the accused committed any unlawful act or omission leading to the death of the deceased, nor did it establish malice aforethought. Consequently, the prosecution did not make out a prima facie case to require the accused to be put on his defence. The accused was therefore found to have no case to answer and was acquitted under Section 306(1) of the Criminal Procedure Code.
