The court found that the prosecution failed to establish a prima facie case against the accused. There was no evidence directly linking the accused to the deceased's death, and the only witness who heard a cry did not see any attack or identify the assailant. Crucially, the prosecution did not prove the fact of death or its cause, as no post-mortem report or medical evidence was produced to confirm that Bernard Wanjohi Mureithi died as a result of an unlawful act. The court held that the evidence amounted to no more than a mere scintilla, insufficient to require the accused to make a defence. Accordingly, the accused was acquitted under section 210 of the Criminal Procedure Code.
