Procedural Posture

Criminal Revision / Revision Order

  1. 1 Whether the warrant of committal for a fine of Kshs.10,000/- in default one year imprisonment was validly issued.
  2. 2 Whether the original custodial sentence of 2½ years imprisonment should be enforced.

Ratio Decidendi

The High Court found that the sentence of a fine of Kshs.10,000/- in default one year imprisonment was not based on the proceedings or the sentence imposed by the trial court. The only lawful sentence was the 2½ years imprisonment imposed on 8/2/2012, which had not been set aside or quashed. The issuance of a warrant of committal for a fine was either a mistake or a forgery, and therefore, the warrant and the fine must be quashed and set aside. The accused is to serve the original custodial sentence.

Court Disposition

Orders

  • The warrant of committal dated 8th February 2012 is quashed and set aside.
