The court held that the Kajiado North Land Disputes Tribunal exceeded its jurisdiction by ordering the excision and transfer of land ownership, as its powers under Section 3(1) of the Land Disputes Tribunal Act are limited to disputes regarding division, boundaries, occupation, or trespass to land, and do not extend to the transfer or registration of title. The Tribunal's decision was therefore ultra vires and liable to be quashed by an order of certiorari. The application was allowed and each party was ordered to bear their own costs.
