Procedural Posture

Criminal Case / Ruling on No Case to Answer

  1. 1 Whether the prosecution established a prima facie case against the accused to require him to defend himself.
  2. 2 Whether the evidence adduced linked the accused to the murder of the deceased.
  3. 3 Whether the death of the deceased was established by admissible evidence.

Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. No witness saw the accused commit the murder, and the only evidence was circumstantial, placing him near the scene but not directly implicating him. Furthermore, the prosecution failed to prove the death of the deceased by not calling a pathologist or anyone who identified the body. The absence of direct or sufficient circumstantial evidence and the failure to establish the death of the deceased meant that the accused had no case to answer. Consequently, the accused was acquitted under Section 306 of the Criminal Procedure Code.
