Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. None of the prosecution witnesses witnessed the murder or provided evidence linking the accused to the offence. The cause of death was not established, as the doctor who performed the autopsy was not called to testify. The only connection between the accused and the deceased was that the accused was allegedly a boda boda rider, which was insufficient to link him to the murder. The court held that suspicion, however strong, cannot form the basis for a conviction. Consequently, the accused was acquitted under Section 306(1) of the Criminal Procedure Code.
