Procedural Posture

Criminal Murder Case / Ruling on No Case to Answer at Close of Prosecution Case

  1. 1 Whether the prosecution established a prima facie case against the accused persons to warrant putting them on their defence.
  2. 2 Whether the evidence of identification by the key prosecution witness was credible and reliable.
  3. 3 Whether there was any other evidence connecting the accused persons to the murder of the deceased.

Ratio Decidendi

The court found that the key prosecution witness, Sheba Takaramoi (PW1), failed to identify any of the accused persons during police identification parades, despite claiming to have seen them at the scene. This inability to recognize the accused, whom she allegedly knew by appearance, cast significant doubt on her evidence. There was no other evidence connecting the accused to the murder. The court held that the prosecution's evidence was discredited and incredible, and thus insufficient to establish a prima facie case. Consequently, the accused persons were found to have no case to answer and were acquitted under section 306(1) of the Criminal Procedure Code.

Court Disposition

acquittal at no case to answer stage

Orders
