The court found that the prosecution failed to establish a prima facie case against the accused persons. None of the witnesses saw the accused attack the deceased, and key witnesses, including the investigating officer and alleged eyewitnesses, were not called to testify. The evidence presented was circumstantial and based on suspicion, which is insufficient to sustain a conviction. The prosecution did not discharge its burden of proof to the standard required in criminal cases. Consequently, the accused persons could not be called upon to make their defence, and the only proper course was to acquit them under section 306(1) of the Criminal Procedure Code.
