Legal Issues
- 1 What is the appropriate sentence for the 1st Accused who pleaded guilty to a lesser charge resulting in loss of life?
- 2 How should mitigation factors such as being a first offender, time in custody, and remorse affect sentencing?
Ratio Decidendi
The court, after considering the mitigation advanced on behalf of the 1st Accused—including his status as a first offender, the period spent in custody, his expression of remorse, and his guilty plea to a lesser charge—found that these factors warranted a sentence less than the maximum prescribed by law. However, the court also recognized the gravity of the offence, noting that a life was lost as a result of the accused's actions. Balancing these considerations, the court exercised its discretion to impose a custodial sentence of eight years' imprisonment, reflecting both the seriousness of the offence and the mitigating circumstances presented.
Court Disposition
1st Accused sentenced to eight years imprisonment; mention for 2nd Accused set for later date.
Orders
- The 1st Accused is sentenced to eight (8) years imprisonment.

REPUBLIC OF KENYA
IN THE HIGH COURT OF KENYA
AT MERU
CRIMINAL CASE NO. 21 OF 2014
REPUBLIC..................................................PROSECUTOR
VERSUS
JULIUS MARI NTONGAI .............................1ST ACCUSED
LIKA MWITHALIE MUROKI .....................2ND ACCUSED
SENTENCING
I have considered the mitigation made on behalf of the 1st Accused. I have considered the length of time he has been in custody, that he is a first offender and that he regrets the act. I have considered that he pleaded guilty for a lesser charge thereby saving the Court time.
However, a life was lost as a result of his action. The maximum sentence is life.
Taking into consideration all the foregoing, I sentence the 1st Accused to eight (8) years imprisonment.
Mention on 18/10/2017 for 2nd Accused.
DATED, THIS 29TH DAY OF JUNE, 2017.
