Legal Issues
- 1 What is the appropriate sentence for the accused convicted of murder given the circumstances of the offence and mitigation?
- 2 Should the accused's status as a first offender and sole breadwinner affect the sentence imposed?
Ratio Decidendi
Although the law prescribes the death penalty for murder, the court considered the accused's mitigation, including his status as a first offender, his role as a family man and sole breadwinner, the positive pre-sentence report, and the four years already spent in custody. The court found these factors sufficient to depart from the mandatory death sentence and instead imposed a custodial sentence of ten years' imprisonment. The court balanced the gravity of the offence, namely the loss of life by a deliberate act, against the mitigating circumstances presented by the accused.
