Ratio Decidendi

The court found that the prosecution failed to prove beyond reasonable doubt that the accused persons participated in the murder of the deceased. The only eyewitness did not see the accused assault the deceased and, in fact, testified that they attempted to prevent the assault. The prosecution did not call all material witnesses, including the investigating officer, and the evidence adduced did not establish the accused's guilt. The accused's presence among the mob was explained and not incriminating. Accordingly, the court acquitted both accused persons for lack of sufficient evidence.
