Legal Issues
- 1 Whether the prosecution has established a prima facie case against the accused to warrant putting him on his defence.
Ratio Decidendi
The court found that the prosecution's evidence connected the accused to the incident sufficiently to establish a prima facie case. Consequently, the accused is required to answer the charge and is placed on his defence. The ruling is based on the legal standard that, at the close of the prosecution's case, the court must determine whether there is evidence upon which a reasonable tribunal could convict if the accused chose to remain silent. The court concluded that this threshold was met, and thus the matter proceeds to defence hearing.
Court Disposition
Accused found to have a case to answer and placed on his defence.
Orders
- The accused is found to have a case to answer and is placed on his defence.
- Defence hearing scheduled for 4th December 2023.

Ruling
1. Having reviewed the evidence presented by the Prosecution, I find the same to connect the Accused to the incident in a manner that calls for his side of the story. It is found that a prima facie case has been established and Accused thus has a case to answer for which reason he is placed on his defence.Defence hearing on 4. 12. 2023.
