Ratio Decidendi

The court found that the 2nd Respondent was not served with the application for leave and did not participate in the substantive proceedings, except for attending court on the date the Notice of Withdrawal was considered. The nature of chamber summons in judicial review is ex parte unless the court orders otherwise, and in this case, the application for stay did not concern the 2nd Respondent. Since the 2nd Respondent was not called upon to respond to the application and incurred no substantive costs in defending the suit, it would not be just to award costs. Therefore, the withdrawal of the suit is with no orders as to costs.
