Miscellaneous Application / Ruling on Application to Deem Notice of Motion Properly Filed

  1. 1 Whether the notice of motion dated 21st November 2011 was properly filed pursuant to leave granted by the court.
  2. 2 Whether the application to deem the notice of motion properly filed was necessary given the sequence of court orders.
  3. 3 Whether the ex parte applicant misconstrued the effect and timing of the leave granted for judicial review proceedings.

Ratio Decidendi

The court found that the leave to file judicial review proceedings was granted on 18th November 2011, and the subsequent review of the orders on 22nd November 2011 merely clarified the original orders without creating new ones. The notice of motion dated 21st November 2011 was therefore properly filed in compliance with the leave granted. The court held that the ex parte applicant misconstrued the effect and timing of the leave, and the present application to deem the notice of motion properly filed was unnecessary. As such, the application was struck out with costs to the interested party.
