The court found that the prosecution had adduced evidence showing that the accused had a quarrel with the deceased on the night in question, was last seen with the deceased before he was found with fatal injuries, and that the medical evidence established death by trauma. These facts, taken together, constituted a prima facie case against the accused. The court held that a reasonable tribunal, properly directing itself to the law and evidence, could convict if no explanation was offered by the defence. Therefore, the accused was required to be put on his defence in accordance with section 306(2) of the Criminal Procedure Code.
