Ratio Decidendi

The High Court determined that the Maseno Law Courts lacked proper geographical jurisdiction over the subject matter of the criminal case. In the interest of justice and to ensure the matter is heard by a court with competent territorial jurisdiction, the file was withdrawn from Maseno Law Courts and transferred to Kombewa Law Courts. The decision was made pursuant to the powers of the High Court under Section 81 of the Criminal Procedure Code, which allows for the transfer of criminal proceedings between subordinate courts where necessary.
