Procedural Posture

Criminal Case / Ruling on Prima Facie Case at Close of Prosecution

  1. 1 Whether the prosecution has established a prima facie case against the accused to warrant him being placed on his defence.

Ratio Decidendi

The court found that the evidence adduced by the nine prosecution witnesses, when considered as a whole, was sufficient to establish a prima facie case against the accused. This finding meets the threshold required under Section 306 of the Criminal Procedure Code, which mandates that if, at the close of the prosecution case, the court is of the opinion that there is evidence sufficient to put the accused on his defence, then the accused must be called upon to do so. The court was satisfied that the prosecution had discharged its initial burden and that the accused should be placed on his defence to answer to the charge.

Court Disposition

Accused placed on his defence.
