The court found that the Kirinyaga Central Division Land Disputes Tribunal acted outside its statutory jurisdiction by purporting to determine a dispute relating to title to registered land and ordering its sub-division and transfer. Section 3(1) of the Land Disputes Tribunals Act limited the Tribunal's jurisdiction to matters of boundaries, occupation, and trespass, not title. The Tribunal's award and the subsequent adoption by the Magistrate's Court were therefore tainted with illegality and ultra vires.
