The court found that the Kisii Municipality Land Disputes Tribunal exceeded its jurisdiction by ordering a re-survey and transfer of registered land, contrary to section 3(1) of the Land Disputes Tribunals Act. The tribunal's award, and its adoption as a judgment by the Chief Magistrate's Court, were therefore nullities for want of jurisdiction. The court held that certiorari could issue to quash both the tribunal's award and the adoption proceedings, as both were made without jurisdiction.
