The court found that the Land Disputes Tribunal had no jurisdiction to determine issues of ownership of land under the repealed Land Disputes Tribunal Act, 1990. The tribunal's decision, which expressly declared the Interested Party as the rightful owner of the disputed land, was therefore ultra vires, null and void. Consequently, the Magistrate's Court could not validly adopt or enforce such a decision. The court further held that the applicant was not barred from seeking judicial review simply because he had not exhausted the appeal process under the Act.
