Judicial Review / Ruling on Contempt Application

  1. 1 Whether the respondent was in contempt of court for disobeying stay orders issued on October 7, 2022.
  2. 2 Whether the stay orders were capable of compliance given the applicant's prior dismissal.
  3. 3 Whether the respondent's conduct amounted to deliberate disobedience of court orders.

Ratio Decidendi

The court found that although the respondent was aware of the court orders, the applicant's summary dismissal had already been effected prior to the issuance of the stay orders. As such, the respondent could not comply with the stay order because there was nothing left to stay. The court concluded that the respondent's non-compliance was not deliberate or willful, and therefore did not amount to contempt of court. The application for contempt was dismissed, but the applicant was granted liberty to pursue further contempt proceedings should the final orders of the court not be complied with.
