The court held that Section 87(a) of the Criminal Procedure Code is expressly limited to trials before subordinate courts and does not extend to murder trials before the High Court. The court found no provision in the Criminal Procedure Code or any other statute that applies Section 87(a) mutatis mutandis to the High Court. Therefore, any application for withdrawal of a murder case in the High Court under Section 87(a) is misconceived and must be rejected.
