The court held that the Land Dispute Tribunal lacked jurisdiction under section 3(1) of the repealed Land Disputes Tribunal Act to determine disputes relating to ownership and title to land. The Tribunal's decision, which purported to declare ownership of the suit property, was therefore ultra vires and a nullity. The subsequent adoption of the award by the Chief Magistrate's Court was equally void. The court further found that claims of adverse possession or prescription fall exclusively within the jurisdiction of the High Court and not the Tribunal.
