The court held that the Land Disputes Tribunal Awendo Division acted outside its statutory jurisdiction by entertaining and determining a dispute concerning ownership and title to registered land. The Tribunal's powers under the Land Disputes Tribunal Act were limited to disputes over boundaries, occupation, or trespass, and did not extend to cancellation of title or determination of ownership. The Tribunal's decision to cancel the applicant's title and order registration in the interested party's name was therefore a nullity.
