The court found that the applicant failed to prove that the subject matter before the Land Disputes Tribunal was the same as that previously litigated in Kitui DMCC No. 388 of 1975, as he did not produce the relevant pleadings and judgment to establish the identity of the land. Consequently, the plea of res judicata could not be sustained. Furthermore, the court held that the Land Disputes Tribunal had jurisdiction to hear disputes relating to trespass to land under the Land Disputes Tribunal Act.
