Ratio Decidendi

The Land Registrar acted outside the scope of statutory mandate by cancelling the 2nd Ex parte Applicant’s title and rectifying the land register without issuing the required statutory notice or affording the registered proprietor a hearing. The Land Registration Act only permits rectification by the Registrar in limited circumstances, and cancellation of title on grounds of fraud or illegality is reserved for the courts. The respondent failed to follow due process, and there was no evidence that the requisite procedures, including service of a 90-day notice and a hearing, were observed. The Interested Party’s allegations of fraud were not substantiated before the Registrar or the court....
