The court found that the Land Registrar acted without jurisdiction in revoking the applicants' titles through a Kenya Gazette notice without affording them a hearing or due process. The Registered Land Act and Government Land Act do not empower the Registrar to cancel a title deed validly issued to a registered proprietor except in cases of fraud or mistake, and even then, only after due process and judicial intervention.
