Legal Issues
- 1 Whether the accused should be treated as a first offender for sentencing purposes.
- 2 What is the appropriate sentence for manslaughter under the circumstances, considering mitigation and pre-sentence report.
Ratio Decidendi
The court found that the accused, having pleaded guilty to manslaughter under a plea agreement, was a first offender with no prior criminal record. The pre-sentence report indicated community readiness to accept the accused and highlighted mitigating factors, including the accused's remorse, time already spent in custody, and the fact that the offence was committed under the influence of alcohol. Weighing these factors, the court determined that a short custodial sentence was appropriate and sentenced the accused to three years imprisonment.
