Ratio Decidendi

The court found that the prosecution had adduced sufficient evidence to establish a prima facie case against the accused for the offence of murder. Applying the standard set out in Section 306 of the Criminal Procedure Code and the guidance from case law, the court held that the evidence, if unchallenged, could result in a conviction. Therefore, the accused must be called upon to make his defence, either personally, through sworn or unsworn statement, or by calling witnesses.
