Procedural Posture

Criminal Case / Ruling on Bail Application

  1. 1 Whether the accused should be admitted to bail or bond pending trial.
  2. 2 Whether there are compelling reasons to deny the accused bail under Article 49(1)(h) of the Constitution.
  3. 3 Whether the security concerns and hostility from the community justify deferral of bond.

Ratio Decidendi

The court found that, although bail is a constitutional right, it may be denied where compelling reasons exist. The pre-bail report and evidence showed ongoing hostility and tension in the community towards the Accused, who had previously been assaulted by members of the public. The court determined that releasing the Accused at this stage would endanger his safety and potentially breach the peace. The court also found no substantive evidence that the Accused would interfere with witnesses. Therefore, the application for bond was deferred to protect the Accused and maintain public order, with liberty to revisit the application after the first hearing when tensions may have subsided.

Court Disposition

Application for bond deferred; accused to remain in custody.

Orders

  • The application for bond is deferred.
  • The accused shall remain in custody.
