Miscellaneous Application / Ruling on Application to Vary Ex Parte Stay Order and Release Funds

  1. 1 Whether the advocate (Ngatia & Associates) can claim a lien over the entire sum held in the joint account or only over the portion due to its former client, the ex parte applicant.
  2. 2 Whether the ex parte stay order should be varied to allow release of the beneficiary's apportioned funds pending determination of the advocate's claim for fees.
  3. 3 Whether the consent order previously recorded vested property rights in the beneficiary, precluding a lien by the advocate over those funds.

Ratio Decidendi

The court held that an advocate's lien is a possessory right that can only attach to property belonging to the client and in the advocate's possession. Once a consent order or court determination vests property rights in a third party (here, the beneficiary), the advocate cannot claim a lien over that portion. The firm may only assert a lien over the portion due to its former client, the ex parte applicant, and only to the extent of its fees. The court exercised its discretion...
