Procedural Posture

Miscellaneous Application / Ruling on Substantive Judicial Review Motion

  1. 1 Whether the Lugari Land Disputes Tribunal acted outside its statutory jurisdiction in making orders relating to title, transfer, and eviction regarding registered land.
  2. 2 Whether the ex-parte applicant was denied a fair hearing before the Tribunal.
  3. 3 Whether the Tribunal's decision was null and void for being ultra vires.

Ratio Decidendi

The court found that the Lugari Land Disputes Tribunal exceeded its statutory jurisdiction by making orders relating to the cancellation of title, transfer of ownership, eviction, and demolition concerning registered land. Section 3(1) of the Land Disputes Tribunals Act limited the Tribunal's powers to disputes over division, boundaries, occupation, or trespass to land. The Tribunal's orders went beyond these parameters and were therefore ultra vires, null, and void. The court also determined that the ex-parte applicant was afforded an opportunity to be heard but failed to attend the Tribunal proceedings despite being summoned, thus negating any claim of denial of a fair hearing....
