The High Court determined that the substance of the ex parte Applicant's grievance relates to the employment and dismissal of the 2nd Respondent, a matter falling squarely within the exclusive jurisdiction of the Employment and Labour Relations Court as provided by Articles 162(2)(a) and 165(5) of the Constitution and section 12 of the Employment and Labour Relations Act. The Court therefore lacked jurisdiction to entertain the application and ordered the transfer of the suit to the Employment and Labour Relations Court at Nairobi for further hearing and determination.
