The court held that the Makueni District Land Dispute Tribunal acted outside its statutory jurisdiction by determining issues of ownership and ordering the transfer of registered land, matters which are expressly excluded from its mandate under section 3(1) of the Land Disputes Tribunals Act. The Tribunal also entertained a claim brought by a party lacking locus standi, as the Interested Party was not an administrator of the deceased's estate, and the ex-parte applicants were sued as individuals without proper authority.
