Although the applicants established that the respondents, as accounting officers, have a statutory duty to settle the decretal amount awarded in the civil suit and that the requirements of Section 21 of the Government Proceedings Act were met, the application for mandamus was fatally defective due to being filed outside the 21-day period specified in the leave order granted by Asati J. The lapse of the leave period rendered the application incompetent and bad in law.
