The court held that, following the declaration of unconstitutionality of the Contempt of Court Act, the applicable law on contempt is the English common law as incorporated by the Judicature Act. Under this regime, and as clarified by the Court of Appeal in Christine Wangari Gachege v. Elizabeth Wanjiru Evans & 11 Others, leave is not required to commence contempt proceedings for breach of a court order. The court found that the ex parte Applicant had demonstrated that the 1st Respondent had failed to pay the interest and costs as ordered, and that the proper procedure was for the Applicant to file and serve an application for contempt of court directly, without seeking leave.
